This publication addresses the rationale and driving forces behind the enforcement of intellectual property rights (IPR) regimes. With reference to the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), the US and the EU, the authors discuss the global IPR landscape, from an economic and legal perspective. They aim to contribute to the debate about how to achieve an appropriate balance between private rights and public interest in implementing IPR enforcement standards and in the allocation of resources to enforcement regimes.
