This study presents legal options available to a group of interested governments to conclude an agreement among themselves on trade in sustainable-energy goods and services either within the existing WTO framework, or outside it. In order to identify viable options for a Sustainable Energy Trade Agreement (SETA), it is imperative to analyze the existing legal frameworks within which a SETA could be negotiated and the resulting legal challenges and opportunities. This paper looks at a number of options under which a SETA could be given legal shape within and outside the WTO and assesses the pros and cons of the various approaches.
