This paper examines Japan’s method of regulating anti-competitive and unfair practices in contractual licenses. The author examines the evolution of the Japanese model of administrative control of forms of conduct in licensing agreements and explains the country’s approach to anti-competition provisions in the Agreement on Trade-related Aspects of Intellectual Property Rights (TRIPS). He also points out possible implications and consequences for developing countries looking to the Japanese case as a model for approaching the relevant TRIPS provisions.
